Commercial Real Estate Loans

Since most financial institutions remain under-allocated in commercial real estate mortgages competition among lending sectors (banks, insurance companies, CMBS and DUS lenders) has become increasingly more aggressive over the past 2 years. Once limited to CMBS, Life Company and DUS lenders, non-recourse financing by select banks has become more prevalent in their attempt to gain additional market share in loan originations. For highly sought after property types these banks will lend up to 75% of value on a non-recourse basis.

Distressed Asset Workout Program

Distressed assets don't just occur in real estate downturns; they can happen anytime - loss of a major tenant, property casualty, death of a key person, bankruptcy, etc. Understanding your rights under the loan documents, finding realistic solutions to an underlying default, and effectively being able to discuss and negotiate with lenders and/or their counsel are paramount to a successful outcome. The L&DA professionals have extensive loan restructuring experience from both sides of the table - on behalf of lenders and borrowers. We understand the limitations, flexibilities and objectives of both the lender and borrower and have been successful in repositioning non-performing loans to our client's satisfaction.

Opportunistic Note Buying

History has shown that it's expensive for lenders to hold on to non-performing loans given the increased pressure to increase loan loss reserves by regulators and politicians alike. As a result, lenders regularly sell non-performing loans on a discounted basis in the market. Because of our institutional background and strong relationships with private lenders & preferred capital providers, LD&A responds quickly when opportunistic note purchases become available.

Joint Venture and Mezzanine Equity
